A further statement from Robert McDowell, Director of Summerhall Management:
“After hearing submissions from Summerhall’s lawyers and those for HMRC on Monday 21st October, the Sheriff was not prepared to dismiss the petition against Summerhall Management, neither was he prepared to grant a winding up order to HMRC and continued the case to 29th November, allowing HMRC to adjust their winding up petition in light of Summerhall Management’s answers.
While it’s good that Summerhall Management was not wound up at the hearing on 21st October, as we continue to defend our position, we remain in a challenging situation.
As explained in previous updates, Summerhall Management’s bank accounts remain frozen which means that we continue to be unable to access funds, due to this ongoing legal action and the restrictions placed on us.
We are able to continue trading under strict parameters, but any income generated is then inaccessible to us as it sits in those accounts that remain frozen.
As we continue to defend our position, we are exploring all avenues with our legal advisors.
We have already written to a number of local and national politicians, councillors and funding bodies to ask for their lobbying support.
I fully appreciate how difficult this information will be to read and how this situation continues to impact staff, artists, customers and suppliers and I want everyone to know that I am doing all that I can to resolve this matter.”
